HALLE BERRY FACES A NEW TURNING POINT IN CUSTODY BATTLE
The custody dispute between Halle Berry and her former husband Olivier Martinez is entering a more serious phase after the French actor accused the actress of physically abusing their 12-year-old son and asked the court to grant him sole custody. Martinez, 60, filed for a temporary restraining order against Berry, alleging that she caused their son “emotional and mental distress due to physical abuse.” Berry’s side immediately rejected the filing, calling it “entirely meritless and deliberately misleading.” The two currently share legal custody, but the new allegations have intensified a conflict that has continued for years.

According to Martinez’s petition, the alleged incident took place at Berry’s home on September 26. He said their son called him and asked to be picked up because Berry had “physically attacked him and choked him.” In his statement, Martinez wrote: “While on the phone with our son, I heard him panicking,” adding that he could hear Berry yelling in the background. These accounts were presented by Martinez in court and do not mean that the allegations have been proven.
The messages Martinez submitted as part of the filing have also become a significant element of the case. According to the documents, Martinez texted Berry to ask whether he could come and pick up their son. Berry allegedly replied: “No I'm not ok with it. He wants to fight his mother?? What kind of kid are we raising.” Martinez then said he called their son again and heard the boy say that he wanted to “leave forever.” According to the petition, Berry responded: “Good. Good. I don't want to see anymore.” When Martinez arrived, he said Berry remained inside the house while their son was helped outside by her “boyfriend.” The filing appeared to refer to Van Hunt, the musician who is currently Berry’s fiancé.
According to the account Martinez included in the petition, after returning to his home, the boy said he had been playing a virtual reality game in his bedroom when Berry entered and began pushing him. Martinez acknowledged in the filing that the initial physical contact may have been intended as playful. However, according to his account, the boy asked his mother to stop so he could continue playing the game. Martinez alleged that this response made Berry angry. The petition then alleges that Berry grabbed her son by the neck and choked him while shouting: “Who is dominant now?! Who is dominant?” These remain allegations made by Martinez and are not findings by the court.
Another detail in the filing is a message Berry allegedly sent the following morning. In it, she wrote: “I feel terrible about what happened last night.” Martinez claimed that the September 26 incident was not the first physical confrontation between Berry and their son. According to him, Berry and the boy had previously discussed occasions when she allegedly placed him in choke holds that Martinez believed were connected to techniques Berry learned through mixed martial arts training. Martinez said their son had objected several times, while Berry characterized the physical contact as joking or playing. The petition alleges that she sometimes held the boy until he had to “tap out.” These claims are also statements presented in the custody dispute rather than established findings.

Based on these allegations, Martinez argued that a domestic violence restraining order should be imposed against Berry and requested a complete change to the existing custody arrangement. He wants sole custody instead of the current shared legal custody arrangement. The conditions Martinez is asking the court to impose on Berry include drug testing before she visits their son, a psychological evaluation, participation in a 52-week intervention program for people accused of domestic violence, and court-ordered protection for himself and the child. Court documents also indicate that Berry and Martinez were ordered to take part in confidential mediation concerning their custody dispute.
Halle Berry’s side responded forcefully to the allegations. Her attorney, Marina Beck, not only rejected Martinez’s filing but also challenged his conduct and credibility. “In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior,” Beck said. “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez.” Berry’s lawyer added that the actress was “deeply saddened” but would continue “fighting for her son’s best interests and providing him with the love and support he needs.” The statements suggest that the dispute is not simply about one isolated incident, but is part of a longer series of disagreements between the former couple following the end of their marriage.
